By purchasing, downloading, installing, or using MIDI Xplorer ("the Software"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Software.

2. License Grant

2.1 Personal License

Upon purchase, you are granted a non-exclusive, non-transferable license to:

• Install and use the Software on up to 2 (two) computers owned or controlled by you
• Use the Software for personal and commercial music production
• Receive free updates within the major version purchased

2.2 Restrictions

You may NOT:

• Share, distribute, or resell your license
• Reverse engineer, decompile, or disassemble the Software
• Remove or alter any proprietary notices or labels
• Use the Software for any unlawful purpose
• Create derivative works based on the Software

3. Intellectual Property

The Software, including all code, graphics, user interface, and documentation, is owned by MIDI Xplorer and protected by copyright and intellectual property laws. Your license does not grant you any ownership rights.

4. MIDI Files and Content

MIDI Xplorer is a tool for browsing and previewing MIDI files. You are responsible for ensuring you have appropriate rights to any MIDI files you use with the Software. We do not provide MIDI content; the Software works with your existing MIDI library.

5. Payment and Pricing

• All prices are in USD unless otherwise stated
• Payment is processed securely through our payment provider
• Your license is delivered electronically upon successful payment
• Prices are subject to change without notice for new purchases

6. Updates and Support

• Free updates are provided within the major version purchased
• Major version upgrades may require additional purchase
• Email support is provided for licensed users
• We reserve the right to discontinue updates at any time

7. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

IN NO EVENT SHALL MIDI XPLORER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SOFTWARE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE.

9. Termination

Your license may be terminated if you breach these Terms. Upon termination, you must destroy all copies of the Software. We reserve the right to disable licenses used in violation of these terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through arbitration.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Software after changes constitutes acceptance of the new Terms.
